Your contract for purchases from the website is with DJ History Limited, registered address 1st floor, 106 Leonard Street, London EC2A 4RH. There is no contract between you and us for the sale of any goods until we have received and accepted your order and received appropriate payment and sent you confirmation by email to the address you have given. Once we do so, whether or not you receive the confirmation email, there is a binding legal contract between us and we will be deemed for all purposes to have effectively communicated it to you. Any orders received by us after 5.00pm GMT/BST shall be deemed to have been received the following day.
Descriptions and prices
The description and price of goods will be as shown on the website at the time you place your order. We make every effort to make sure descriptions and prices are correct. If an error is found we will inform you as soon as possible and give you the option of either cancelling your order and being refunded for it or reconfirming the order at the correct price. Goods are subject to availability. If the goods are not in stock when we receive your order we will inform you as soon as possible and refund or recredit any charges we have made for the goods. For some goods you must pay a delivery charge. Prices and delivery charges include VAT. We reserve the right to change prices without any notice and without any obligation.
Although you may remain on our site your transaction is processed by the payment gateways provided by CreditCall and Paypal. They provide a reliable and secure service, but we are not responsible for the correct functioning of their systems, nor for any loss or damage occurring as a result of their error or failure.
We will make every effort to deliver your goods as soon as possible and within 30 days of your order. We will inform you if there is further delay. However we are not liable for any loss or damage suffered by you due to any delay in delivery. The goods will be dispatched to the delivery address you gave with your order. If delivery cannot be made to this address or if there is no one there who can accept delivery, you will be notified of an alternate delivery date or a place where you can collect the goods. If delivery cannot be made and the goods are returned to us we will refund you the cost of the goods excluding the postage and packing. Once the goods are delivered to you you become the owner and fully responsible for them.
You have the right to cancel the contract, for any reason, up to seven working days (days other than weekends and public holidays) after you receive the goods. To cancel the contract, give notice in writing, including full details of your order, to firstname.lastname@example.org or to DJ History, 1st floor, 106 Leonard St, London EC2A 4RH.
Damaged, faulty or incorrect goods
If you receive goods that are damaged or defective, we shall at our own option either replace or repair them or refund you the cost of the goods and the postage and packing, provided you return them to us as described below. If you receive incorrect goods from us we will replace them with the correct goods or refund you the cost of the goods and the postage and packing, provided you return them to us as described below.
If you cancel your contract after the goods have been dispatched you will be responsible for returning them to us at your own cost. Goods must be in the condition in which they were delivered to you and you must take reasonable care to ensure they are not damaged in the meantime or in transit. Please package them carefully because if they are damaged due to inadequate packaging we will not give a refund. Send the package to DJ History RETURNS, 1st floor, 106 Leonard St, London EC2A 4RH. We recommend you use recorded delivery.
Once you have notified us that you are cancelling your contract we will refund or recredit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods, provided that you return the goods in question in the condition in which they were delivered to you.
Orders for digital music downloads are subject to the same terms and conditions as described above with the exception that all download sales are final and you will have no right to cancel your contract once the sale is confirmed. A sale is confirmed immediately when you begin to download a file containing a track or tracks you have purchased from the website. The system will allow you up to three downloads or 48 hours (whichever comes first). If after this you have been unable to successfully download your music or if a music file on the website is damaged, corrupted or incorrect, inform us in writing to email@example.com as soon as possible and we will make every reasonable effort to correct this and provide you with the correct file. If DJ History Ltd loses the right to make certain tracks available you will no longer be able to download them from anywhere on the site. In such an event we are not liable for any loss or damage you may incur as a result. Our music downloads are licensed, hosted and made available to DJ History Ltd by Juno Download Ltd, 10 Greenland Street, London NW1 0ND who are wholly responsible for their quality and availability. By contracting with DJ History Ltd for the purchase of digital music downloads you also agree to all of Juno Download's terms and conditions. Due to licensing restrictions music displayed in our shop may not be available to customers in all territories.
You shall be authorised to use digital music files downloaded from djhistory.com for personal non-commercial use only. You may not use downloads or the music they contain in any way that contravenes copyright or other intellectual property laws, including but not limited to redistribution, transfer, sublicensing, file-sharing and unlicensed performance.
Orders sent to a non-UK address may be subject to additional taxes and duties charged in the destination country for the importation of the goods or for clearing customs. The consignee (the person to whom the package is addressed) is responsible for any such charges. You should check with your local post office or customs service about what charges are payable and how they are collected.
